Forsyth’s Superior Court Criminal Division maintains felony case files. The State Court Criminal and Traffic Division handles its misdemeanor and traffic cases. Some matters are in Cumming Municipal Court, so use the court written on the person’s documents rather than sending everyone to one courthouse.

Who can set bail
Forsyth Magistrate Court’s jurisdiction includes granting bail when it is not exclusively reserved to another court. Georgia’s first-appearance rule instructs the judicial officer to set bail within that authority or explain that a Superior Court judge must do so. A felony label alone does not establish that a bail bond is unavailable.
