Probation violations and other holds

Find out what still prevents release when a new charge has a bail bond amount.

THE QUICK ANSWER

When someone has a new charge and a separate probation matter, check both. Paying the new charge’s bail bond does not establish that the separate custody order has been resolved.

Ask what remains open

Have the person’s name and booking information ready. Ask the jail which charge or order prevents release, which court or agency issued it, and whether it requires another bail bond or hearing. Write down each case number. These are questions for the current record, not facts that can be inferred from a total bail bond amount.

Probation is connected to an existing sentence

A probation violation concerns conditions imposed in an earlier case. The sentencing court retains authority over probation. An allegation of a new crime and an alleged failure to comply with probation can require separate decisions. Contact the attorney handling the probation matter or the court that imposed the sentence to identify the next hearing.

Do not assume every violation has the same outcome

Georgia’s misdemeanor probation guidance distinguishes failure to pay, failure to report and other violations. It includes specific procedures and consideration of alternatives to confinement. Those rules do not establish a universal bail bond amount, guaranteed release time or automatic outcome for a particular person.

What if another county has a hold?

An active matter from another county is separate from the Forsyth charge. Ask the jail which county issued the hold, what case it concerns and whether another release decision or transfer remains. Do not assume paying the Forsyth bail bond clears the other county’s matter.

Does a criminal bail bond remove an immigration hold?

Posting a local criminal bail bond does not itself resolve a separate immigration custody matter. ICE describes an immigration detainer as a request to a jail or other agency concerning release and transfer to federal custody. Ask the jail whether an immigration detainer or other federal custody order is involved, and have counsel identify the separate process that applies.

Questions about a bail bond or a hold?

Ask about the bail bond requirements. Posting a bail bond does not remove a separate hold or court order.
