Before posting the bail bond

The sheriff describes a check mailed to the listed security, typically in two to three weeks after the case has been adjudicated. This is the sheriff's published estimate, not a guaranteed payment deadline. Call the Clerk of Court at 770-781-2120 about disbursement.

A company fee follows different rules

A company’s signing fee is different from the cash bail bond deposit. Finishing the case does not by itself require return of that fee. If the company surrenders the defendant to the court, sheriff or another law enforcement officer in the jurisdiction where the bail bond was made before final disposition, Georgia law requires return of the signing compensation to the defendant unless a statutory exception applies.

  • The defendant is arrested for another crime other than a traffic or local ordinance violation.
  • A cosigner gives a written request to be released from the bail bond.
  • The defendant fails to tell the company about an address change.
  • The fee remains unpaid after notice by certified mail or statutory overnight delivery that it is past due.
  • The defendant fails to notify the company upon leaving the court’s jurisdiction.
  • The defendant supplies false information to the company.

The statute also allows the company to retain the signing compensation when surrender follows forfeiture of the bail bond. Ask which provision applies. These rules concern the company’s signing compensation; the sheriff’s cash refund follows the separate named-security procedure above.

Avoid overpaying

The sheriff says an overpayment goes to the inmate's account and is returned to the inmate at release by debit card or check. Confirm the exact amount due before bringing payment.

Property pledged directly to the sheriff

A Forsyth real property bail bond creates a recorded lien. The sheriff places responsibility on the property owner to ensure removal by presenting proof that the charges are resolved and the defendant no longer must appear on them. Obtain the disposition and ask the Bond Administrator what documentation is needed. Collateral given to a private company follows a separate agreement.
